Should my landlord’s insurance cover my damages due to ice on the driveway?

Do I have the right to ask the owner of the garage of the rental condo block to have his insurance compensate me somehow ?

Dear Insurance Nik,
Just need an advice if possible please. My car slipped very bad while entering in the indoor garage of the rental condo block. All the front, the hood etc… got damaged. I also hurt my front and my arm and I stayed one week without working ( Self employed so no benefits). All that was because of the salt lack in the entrance of the garage  – it was a real skating rink. My car is SUV, Toyota RAV4 of 2018, so a good car. My question is :
Do I have the right to ask the owner of the garage of the rental condo block to have his insurance compensate me somehow ?

Dear On Ice,

In Quebec we are regulated by The SAAQ which determines the insurance for all automobiles, drivers and pedestrians. The insurance company pays out damages and apportions responsibility according to circumstances and SAAQ regulations. Since you are the driver of the automobile and were in the automobile at the time of the incident, the SAAQ directives apply. Your insurance company will pay for the damage sustained to your car.

By law the RAMQ (i.e. Medicare) will take over expenses for bodily injuries. The SAAQ will only pay extended benefits in case of permanent disability. Your insurance company will pay you for the damage to your car and any extra expenses as applicable under your coverage. Time off from work may be included in your claims application by your insurance agent.

Please contact your auto insurance agent without delay and file an application to claim for damages. Your agent will arrange for a replacement automobile for you and any extra costs as per your insurance coverage plan.

It is necessary to report the incident as soon as possible  and file the claims applications immediately with your agent as any unjustified delay in informing the insurance company can result in your claim being rejected.
